Dow Corning Breast Implant Settlement
On May 1, 2001, researchers from the Food and Drug Administration
and the National Institutes of Health announced that they
had found that when silicone gel spreads outside the border
of scar tissue around the breast area, cases of fibromyalgia
increased significantly. This is the first study of women
whose implants were known to have burst. Fibromyalgia is a
syndrome with no clear biological cause that results in generalized
pain and tenderness, sleep disturbance and complaints of loss
of mental capacity.
The Settlement Facility for Dow Corning's bankruptcy is now
accepting claims for compensation from the Claims Forms Package
mailed in February, 2003. Once the court grants final approval
of the joint plan of reorganization, payments can be made
to claimants who were implanted with Dow Corning breast implants.
Final court approval is expected shortly.
Money may be paid to those persons who were implanted with
Dow Corning breast implants for:
- Medical costs to remove Dow Corning implants;
- Rupture of a Dow Corning implant;
- Disease with a resulting disability (includes disfigurement,
hardening of breasts, silicone gel migration, fatigue, joint
pain) or advance payment for release of the disease claim.
If your claim warrants doing so, you may want to opt out
of the settlement and pursue your rights in a litigation fund
which is a separate part of the settlement trust. If you have
ever been implanted with Dow Corning Breast Implants, you
may be entitled to financial compensation.
